The NurBus Limited Liability Partnership (hereinafter referred to as the “Company”), state registration certificate No. 10100309330732 of January 30, 2019, in accordance with paragraph 5 of Article 395 of the Civil Code of the Republic of Kazakhstan, publishes this proposal as a public offer. The purchase of the Company's services without concluding a separate agreement for the provision of services is recognized as the acceptance of these Terms and Conditions by a person using the services of the Company (hereinafter referred to as the “Customer”).
1. General Conditions:
1.1. The company provides services to the Customer for conducting sightseeing tours on a sightseeing bus in Almaty (hereinafter “Tours”) for the price indicated on the ticket and on the conditions specified here;
1.2. The Customer pays for the ticket price and uses the services of the Company included in the ticket price and on the conditions specified here;
2.1. The Company undertakes to conduct Tours on a sightseeing bus in a technically sound condition and safe for its operation. The Tours have a specific route and are carried out according to the current schedule on the day the ticket is used, and are also accompanied by a live guide or audio recordings in Kazakh, Russian and English languages;
2.2. The Customer agrees to abide by the general rules of conduct and safety rules during the use of the Tours.
3.1. Each time, when boarding the bus, the Customer must present a valid ticket. If there is no valid ticket, the Customer can purchase the ticket on the bus;
3.2. The Customer may occupy any free seat. In the absence of free seats, the Customer can wait for the next bus;
3.3. The Customer is forbidden to smoke and drink alcohol on the bus, as well as behave aggressively towards other passengers;
3.4. The Customer cannot walk inside the bus and lean out of the bus while the bus is moving;
3.5. The Customer can talk a bus driver only during stops, without distracting the driver while he is driving;
3.6. The Customer is not allowed to throw rubbish inside the bus as well as out of the bus. The Customer must use a special bag for garbage on the bus;
3.7. The Customer is responsible for causing material damage to the property of the Company, as well as the property of other passengers and third parties as a result of unlawful actions on the part of the Customer;
3.8. The Customer may ask for help from company representatives including the bus driver, in the case of emergency at any time. Urgent assistance implies measures necessary to prevent the danger to life and health of both the Customer and other passengers. At the same time, the representative of the Company acts within its authority;
3.9. The Customer must take care of his/her personal belongings during the Tours as the Company is not liable for any loss and/or damage of passengers’ personal property left unattended on the bus;
3.10. The Customer must leave the bus at the first request of a representative of the Company including the bus driver, despite having a valid ticket. The Customer can appeal to the Company’s office or directly to the court against the actions of the Company’s representative.
4.1. The Company provides services to the Customer on terms of 100% payment, which is confirmed by the presence of a valid ticket. A valid ticket is a ticket valid on the date of its presentation (activation) by the Customer for the use of the Tours;
4.2. The ticket is valid for the period indicated on the ticket and can be used within 1 (One) week from the date indicated on the ticket. For example, the Customer bought a ticket for a certain date, but could not use (activate) the ticket on that day, then the Customer can activate the ticket within the next 7 (Seven) days;
4.3. The Company guarantees the Customer a refund of the ticket price in case of cancellation of the Tours for subjective reasons. Refunds are made within 5 (Five) banking days when purchasing a ticket by bank transfer and within 1 (One calendar day) when purchasing a ticket in cash;
4.4. The Company does not refund money to the Customer for the purchased ticket in case of cancellation of the Tours for objective reasons. These include circumstances of force majeure in accordance with the legislation of the Republic of Kazakhstan, adverse weather conditions that impede the Tours, and blocking the streets along the Tours’ route for over 2 (Two) hours;
4.5. The Customer can cancel a ticket purchased in advance, while the money for the ticket must be returned to the Customer when the ticket is canceled at least 24 (Twenty four) hours before the date indicated on the ticket. A ticket purchased directly on the bus cannot be canceled, as its validity period starts from the moment of purchase;
4.6. The Company is not responsible for the ticket purchased by the Customer from organizations that are not entitled to sell the Tours. In the case when the barcode (QR code) of the ticket is not accepted by the reader/scanner on the bus, such ticket is not valid.
5. Other conditions:
5.1. The Customer agrees that the use of the online ticket purchase service entails the registration procedure on the Company's website;
5.2. The Customer gives his consent to the use and processing of his/her personal data;
5.3. The Company uses the information provided by the Customer to fulfill its obligations to the Customer and to register the Customer on the Company's website;
5.4. The Company undertakes not to disclose the information received from the Customer. The provision of information by the Company to agents and third parties acting on the basis of an agreement with the Company for the fulfillment of obligations to the Customer is not considered a violation. The disclosure of information in accordance with reasonable and applicable requirements of the law is not considered a violation of obligations;
5.5. The Company uses the technology of cookies. Cookies do not contain confidential information and are not transferred to third parties. The company receives information about the IP-address of the visitor of the Company’s website. This information is not used to identify the visitor, except in cases of fraudulent activity;
5.6. The Customer is responsible for the accuracy of the personal data provided to the Company;
5.7. The Customer agrees that for receiving services, his/her personal data will be processed by JSC Forte Bank;
5.8. The Сustomer is responsible for unauthorized access to his/her personal data and ensures the confidentiality of access to his/her personal data. Moreover, all actions within or using access to the personal data of the Customer are considered to be performed by the Customer;
5.9. The Customer agrees that telephone conversations are recorded to improve the quality of services and confirm the oral statements of the Customer;
5.10. The Company has the right at any time to change the terms and conditions of the Offer unilaterally without prior approval from the Customer, while ensuring the publication of changes on the Company's website;
5.11. The Company is not liable for possible risks and conditions of safe use, as well as for network attacks or hacking of the Company’s website including, but not limited to, malfunctioning of the Company’s website due to technical reasons;
5.12. All disputes and disagreements arising from legal relations under this Offer are to be resolved through negotiations. If it is impossible to resolve disputes during negotiations, such disputes must be referred to a court of the Republic of Kazakhstan, the city of Almaty, with mandatory compliance with the claim procedure. The term for responding to a claim is 10 (ten) calendar days from the date of receipt;
5.13. Images and texts published on the Site are protected by copyright. Any use of materials is possible only with the written permission of the Company.
